The website operator of EKT Humpty Dumpty e.V. takes your privacy very seriously and treats your personal data confidentially and in accordance with legal regulations. As changes to this privacy policy may occur due to new technologies and the continuous development of this website, we recommend that you review the privacy policy periodically.

1. Access Data

The website operator or hosting provider collects data about website accesses based on the legitimate interests of EKT Humpty Dumpty e.V. (see Art. 6(1)(f) GDPR) and stores them as “server log files” on the website’s server. The following data is logged:

In the contractual relationship with EKT Humpty Dumpty e.V., you must provide the personal data required to fulfill contractual obligations (especially childcare services and child welfare). Relevant personal data includes, for example, details of parents/legal guardians (name, first name, date of birth, contact details, nationality) as well as the details of the child(ren) being cared for. For processing any payment obligations, bank details may also be collected, based on your provided information.

5. Purpose of Processing and Legal Basis

We process personal data in accordance with the provisions of the European General Data Protection Regulation (GDPR) and the Berlin Data Protection Act.

Consent (Art. 6(1)(a) GDPR)

If you have given us consent for the processing of personal data for specific purposes (e.g., participation of your child in events, photo and video recordings), the processing is lawful. Consent given can be revoked at any time with future effect. Data processed before revocation remains lawful and is not affected by the revocation.

Fulfillment of Contractual Obligations (Art. 6(1)(b) GDPR)

The processing of personal data is carried out for the execution of pre-contractual measures (e.g., pre-registration) and for fulfilling our existing contractual relationships with you.

Legal Obligations (Art. 6(1)(c) GDPR)

The collection of personal data is also carried out to comply with legal requirements to ensure childcare services (§§ 61 ff SGB VIII, §§ 67 ff SGB X, Child Daycare Promotion Act and related regulations).

Protection of Vital Interests of the Data Subject (Art. 6(1)(d) in conjunction with Art. 9 GDPR)

This includes, for example, the collection of health data of the child being cared for, as well as information on dietary restrictions if necessary. The collection of this data is also based on information provided by the affected parents/legal guardians.

6. Use of Data and Storage Duration

When you contact EKT Humpty Dumpty e.V., your information is stored so that it can be referenced for processing and responding to your inquiry.

Within EKT Humpty Dumpty e.V., only board members have access to the data, and only to the extent necessary to fulfill contractual and legal obligations. Data is only disclosed to recipients outside of the childcare center when there is a legal obligation or with the explicit consent of the data subject. No data is transferred to entities outside the EU.

Your personal data is stored for as long as necessary to fulfill our contractual and legal obligations. Even after the childcare relationship ends, statutory retention periods must be observed.

7. Routine Deletion and Blocking of Personal Data

The responsible entity at EKT Humpty Dumpty e.V. processes and stores personal data only for the period necessary to achieve the storage purpose or as stipulated by the European Directive and Regulation Provider or another legislator in laws or regulations applicable to the responsible entity.

If the storage purpose ceases to apply or a prescribed storage period expires, personal data is routinely blocked or deleted in accordance with legal regulations.

8. Data Protection in Job Applications and Recruitment

EKT Humpty Dumpty e.V. collects and processes the personal data of applicants for the purpose of managing the application process. Processing may also be carried out electronically, particularly when an applicant submits application documents electronically (e.g., by email or via a web form on the website). If EKT Humpty Dumpty e.V. concludes an employment contract with an applicant, the provided data will be stored for employment purposes in compliance with legal regulations. If no employment contract is concluded, the application documents will be automatically deleted two months after the rejection decision unless deletion is opposed by other legitimate interests (e.g., burden of proof in an anti-discrimination lawsuit).

In compliance with Art. 13(1) GDPR, we fulfill our information obligation regarding the collection of personal data. You have the right to:

• Have your data corrected if it is incorrect (Art. 16 GDPR)

• Have your data deleted or restricted if storage is unlawful or no longer necessary (Art. 17, 18 GDPR)

• Transfer your data (Art. 20 GDPR), e.g., when changing childcare providers

• Object to the use of your data for specific purposes (e.g., event participation, photos, birthday lists, emergency contact lists), if processing is based on your prior consent (Art. 21 GDPR)

• File a complaint with the Berlin Commissioner for Data Protection and Freedom of Information if you believe that the processing of your personal data is unlawful (Art. 77 GDPR)

10. Data Deletion

Unless legal retention obligations prevent it, you have the right to request the deletion of your data. Stored data is deleted if it is no longer necessary for its intended purpose and no legal retention obligations exist. If deletion is not possible due to legal reasons, data processing will be restricted, meaning the data will be locked and not processed for other purposes.

11. Right to Object

Users of this website may exercise their right to object at any time and oppose the processing of their personal data.
